Counsel for former Rep. Stephen Buyer (R-Ind.) asked a panel of Second Circuit judges to reverse his convictions for insider trading on Wednesday.
The judges’ questions focused primarily on whether the admission of a forensic report of cellphone data generated by a computer program is testimonial for purposes of the Sixth Amendment’s confrontation clause.
They also pressed the parties on whether Buyer’s case would be a good vehicle for revisiting the court’s case law concerning venue in securities cases.
Buyer allegedly acquired the nonpublic information he traded on through his work as a consultant.
