Former Decision Diagnostics Corp. CEO Keith Berman lost his bid to undo an 84-month prison sentence for securities fraud after the DC Circuit rejected his challenges to the district court’s $27.8 million loss calculation.
The district court’s determination that the fraud ended when Berman was indicted and not at some earlier time was “amply supported” by the record, the US Court of Appeals for the District of Columbia said Friday.
