Ex-Capital One Worker Given Another Chance at Some Claims

A former Capital One employee alleging discrimination, retaliation, and harassment arising from her pregnancy and related disability will get another chance to state her claims under California law, a federal judge said.

Dolores White’s claims for retaliation in violation of California Labor Code Section 246.5, for harassment in violation of the California Fair Employment and Housing Act, and for interference and retaliation in violation of the California Family Rights Act, were dismissed with leave to amend, Judge Kirk E. Sherriff, of US District Court for Eastern District of California, said.
