A former BNSF Railway Co. locomotive engineer who lost his job after a collision waited too long to file a suit alleging the company held him to higher standards because he’s Black.
The worker, who didn’t file a required agency charge until nearly two years after his firing, argued that the 300-day limitations period should be tolled because he diligently pursued an out-of-court resolution first. But he failed to convince the US District Court for the Southern District of Texas that public policy considerations support applying equitable tolling, the Wednesday opinion said.
