Former Baltimore state’s attorney Marilyn Mosby won an appeal to undo her conviction for mortgage fraud Friday when a federal appeals court ruled the trial court gave the jury bad venue instructions.
The US Court of Appeals for the Fourth Circuit appeals affirmed her convictions for perjury, however, rejecting the claim that a distribution request form on which she was accused of lying was “fundamentally ambiguous.”
At Mosby’s mortgage fraud trial—held separately from the perjury trial—the jury was told that so long as some act in furtherance of the crime occurred within the District of Maryland, venue was proper there. ...
