Ethicon, Bard Get Pelvic Mesh Verdicts Totaling $83 Million Axed

Ethicon Inc. and C.R. Bard Inc. got $15 million and $68 million pelvic mesh verdicts thrown out, as a New Jersey appeals court ordered new trials Tuesday, saying a trial court was wrong to categorically bar evidence concerning the devices’ marketing clearance.

In 2017, a jury found Ethicon Inc. and Johnson & Johnson liable for defective design and inadequate warning under New Jersey products liability laws. It awarded Elizabeth Hrymoc and her husband, Tadeusz Hrymoc, $5 million in compensatory damages, and punitive damages of $10 million.
