Estate’s Missed Medical Diagnosis Suit Filed Too Late in Indiana

The estate of an Indiana man whose death allegedly could have been prevented by an earlier diagnosis of a brain injury waited too long to file a suit against a doctor accused of misreading a diagnostic test, a state appeals court said.

Indiana’s two-year time limit for filing a medical malpractice case begins to run at the time of the alleged injury, unless it couldn’t have been discovered earlier with reasonable diligence, the Indiana Court of Appeals said.
