A New York judge tossed former Jets defensive end Mark Gastineau’s lawsuit challenging how he was depicted in a documentary film by ESPN and the National Football League.
Gastineau, among other things, claimed ESPN and the NFL misappropriated his name and likeness when they included in the film a confrontation with former Green Bay Packers quarterback Brett Favre. But Gastineau consented in writing to use of his name and likeness in connection with the film, Judge Paul A. Engelmayer of the US District Court for the Southern District of New York said in his Monday opinion.
