EPA’s N.J. Superfund Listing Decision Withstands Legal Challenge

A chemical company failed to convince a federal appeals court in Washington to overturn an EPA decision to place a contaminated New Jersey site on its high priorities list for cleanup, despite backing from both national and state trade groups, according to the court’s per curiam order released Friday.

Troy Chemical Corp. Inc., one of the parties potentially responsible for cleanup at the Newark site, argued against the Environmental Protection Agency’s decision before the U.S. Court of Appeals for the District of Columbia Circuit in September.
