EPA Plan for Drifting State Air Pollution Overdue, Lawsuit Says

The EPA failed to timely issue federal plans for limiting drifting air pollution from New Mexico, Pennsylvania, Utah, and Virginia, environmental groups say in a new lawsuit in a California federal court.

The Environmental Protection Agency’s delay violates the Clean Air Act, according to the lawsuit filed in the U.S. District Court for the Northern District of California. The act’s “Good Neighbor” provision requires states to limit pollution that contributes to downwind areas’ failure to meet national air standards, the lawsuit says.
