English Construction Co. convinced a federal court to dismiss a proposed employee data breach class suit under the home-state exception to the Class Action Fairness Act.
The plaintiffs alleged that English Construction’s computer systems were hacked and their personal information, including Social Security and driver’s license numbers, was stolen. Senior Judge Norman K. Moon of the US District Court for the Western District of Virginia the case dismissed without prejudice to filing the local matter to state court.
