Enfamil Maker Trims Claims in Heavy Metal Contamination Suit

Mead Johnson & Co. LLC convinced a federal judge in Illinois to dismiss warranty and fraud claims from a proposed class action alleging that seven types of the company’s Enfamil infant formula contain undisclosed heavy metals.

The US District Court for the Northern District of Illinois on Monday said the consumer who brought the case didn’t allege she fulfilled the pre-suit notice requirement for her breach of warranty claim or sufficiently allege her fraud claims. The court, however, allowed her claims under the Illinois Consumer Fraud Act to proceed.
