End California Auto-Retirement Program, Tax Group Tells SCOTUS

A taxpayer policy group is taking its challenge to California’s automatic retirement program to the U.S. Supreme Court, urging the justices to invalidate the program as preempted by the federal Employee Retirement Income Security Act.

The CalSavers Retirement Savings Program creates automatic retirement savings vehicles for California workers without employer-sponsored plans. It is an invalid attempt by the state to insert itself into the federally preempted field of workplace retirement plans and impose mandates and rules that conflict with ERISA, the Howard Jarvis Taxpayers Association said in an Oct. 15 petition for Supreme Court review.
