A wearable breast milk pump manufacturer’s counterclaim in a patent infringement suit involving pump designs didn’t adequately specify what trade dress was protected, a federal court ruled.
Wearable breast pump manufacturer Willow Innovations Inc. had sued competitor Chiaro Technology Ltd., which does business as Elvie, for infringing patents related to its Willow Pumps. According to Williow, its pumps are inconspicuous and convenient—they have a natural breast profile, fit inside a bra, and the storage containers can be positioned around the breasts.
