Ellenoff Grossman Loses Bid to Arbitrate Lawyer’s Reprisal Claim

A former associate attorney with Ellenoff Grossman & Schole LLP can pursue in state court her claim that she was fired for reporting a fellow lawyer’s sexual harassment, a federal judge ruled.

The decision by the US District Court for the Southern District of New York is the latest to examine the scope of the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act. That law enables workers to opt out of otherwise binding arbitration agreements when a dispute involves a sexual assault or sexual harassment that arose or accrued after its March 2022 effective date.
