Eleventh Circuit Refuses to Revisit Class Incentive Award Ban

A federal appeals court is sticking with its September 2020 panel ruling that a class action representative is barred from receiving a $6,000 incentive award in a robocalling case that settled for $1.4 million.

A majority of judges on the US Court of Appeals for the Eleventh Circuit voted against granting rehearing en banc, according to the court’s Wednesday order.

Class representative Charles Johnson and others sued NPAS Solutions LLC, alleging violations of the Telephone Consumer Protection Act. Class member Jenna Dickenson objected to an incentive awards to Johnson provided by the settlement.
