El Paso Urges Texas Court to Ditch Tax Foreclosure Surplus Case

A former homeowner properly was denied the surplus funds from a tax foreclosure sale because he failed to submit a timely claim for them, the city of El Paso, Texas, told a state appeals court.

George Baily’s reason for the delay—that the excess funds notice was sent to the wrong address—doesn’t mean the city didn’t comply with state law, the city said in a July 28 brief.
