A 2021 Missouri law that sought to undercut federal regulation of firearms is unconstitutional because it violates the US Constitution’s supremacy clause, the Eighth Circuit said Monday.
A district court’s ruling blocking the state from enforcing its Second Amendment Preservation Act was therefore proper, the court said. The supremacy clause maintains states can’t pass laws inconsistent with federal laws.
