EEOC Sues Wendy’s Alleging Bias Against Disabled, Older Manager

Wendy’s International LLC fired a district manager because of his age and disability after refusing to let him return to work with minor lifting restrictions following surgery, a new EEOC lawsuit says.

Michael Salsburg’s impairments included ulnar neuropathy, cubital tunnel syndrome, and carpal tunnel syndrome, according to the Equal Employment Opportunity Commission’s complaint filed Monday in the US District Court for the Southern District of Ohio. Salsburg’s doctor cleared him to return to work in February 2023 after surgeries in late 2022, but restricted his lifting to no more than 10 pounds with his right hand, and Wendy’s was informed ...
