EEOC Scores Bias Trial for Depressed Juvenile Defender Attorney

The Defender Association of Philadelphia will face trial on whether it failed to accommodate and fired because of her disability an attorney who was diagnosed with mental health issues while working with juveniles charged with sex-based crimes.

The Equal Employment Opportunity Commission, which represents the unnamed lawyer, raised questions for a jury on whether she would’ve been able to perform her essential job functions in the near future if she’d been given more time off, the US District Court for the Eastern District of Pennsylvania said.
