The Second Circuit Thursday declined to bless a new settlement between the EEOC and New York labor unions in a 53-year-old discrimination lawsuit over hiring bias against Black and Hispanic ironworkers.
A lower court was on solid ground in finding a 2019 proposed consent decree in the 1971 suit against Local 580 of the International Association of Bridge, Structural, and Ornamental Ironworkers and others wasn’t shown to be fair and reasonable, or in the public interest, a unanimous appeals panel said.
