EEOC, Indian-Born Female Manager Head to Trial in Bias Case (1)

The EEOC must defend at trial claims it discriminated against an acting field director based on her national origin, race, and sex by denying her a promotion to field director, a Louisiana federal court ruled Monday.

A jury could find Uma Kandan had evidence that the Equal Employment Opportunity Commission’s explanation to select a Black man with extensive military experience but short tenure at the agency as the New Orleans field office director was a cover for bias because she was born in India and is a woman, the US District Court for the Eastern District of Louisiana said.
