Education Department Gets Immigration Policy Challenge Dismissed

The US Department of Education won dismissal for now of a suit alleging its new policy improperly requires Native American students born in Canada to submit immigration status documents to receive student aid.

Plaintiffs Mercedes Rourke-Rodriguez, Ariwiio Swamp, and Jayla Thompson, who are all members of the federally recognized Saint Regis Mohawk Tribe, didn’t plausibly allege a certain impending future injury needed to establish standing to sue, Judge Anthony J. Brindisi of the US District Court for the Northern District of New York said in a Tuesday order granting the government’s motion to dismiss.
