An Eddie Bauer LLC customer who said the retailer advertised fake sales is allowed to sue under Oregon’s consumer protection law, the state supreme court said Thursday.
A retail purchaser can pursue claims if the alleged consumer law violation arises from a representation about the product’s price, even absent a challenge to the character or quality of the product itself, the court said.
