A proposed class action alleging Easterseals-Goodwill Northern Rocky Mountain Inc. failed to protect employees’ personal information in a 2021 data breach barely survived the nonprofit’s motion to dismiss.
Jamie Kilgore and B.E. failed to show they suffered a concrete injury traceable to the data breach, a requirement for establishing standing to sue, Judge Dale A. Kimball of the US District Court for the District of Utah said Tuesday.
However, Kimball denied Easterseals-Goodwill’s motion to dismiss “out of an abundance of caution,” and granted the plaintiffs until Oct. 20 to conduct discovery related to the employer’s factual challenge to standing.
