Early Loss for Titlemax in Suit Over Calls to Reassigned Number

Titlemax of Va. Inc. will have to face a lawsuit alleging that calls it made to a telephone number that had been relinquished by a Titlemax customer and reassigned to a new person violated the Telephone Consumer Protection Act, a federal court ruled.

The TCPA requires callers to obtain express consent from the called party before making calls with a prerecorded or artificial voice, and doesn’t create an exception or safe harbor for callers who obtained consent from a previous subscriber to the number, Judge R.
