Dynatrace Hit With Wiretap Suit Over Session Replay Software (1)

Technology company Dynatrace Inc. must face a proposed class action alleging its session replay software recorded the website communications of visitors to the Ulta Beauty website in violation of the Massachusetts wiretap statute and state privacy laws.

Alyssa Gary and Marla Defoort alleged that Dynatrace’s software installed on its clients websites recorded visitors’ keystrokes, mouse clicks, data entry, and other electronic communications without their knowledge or consent.

The software functioned as a wiretap because it redirected information about users’ interactions with websites to Dynatrace despite the fact that it wasn’t an intended recipient of the communications, according to a complaint ...
