Duty-Free Retailer Employees Advance Suit Over 2024 Data Breach

International Shoppes LLC and Diplomatic Duty Free Shops of New York Inc. must face some claims as part of a proposed class action alleging they negligently failed to protect the sensitive information of customers, employees, and vendors in a 2023 data breach.

The plaintiffs adequately pleaded their negligence, breach-of-contract, and declaratory judgment claims to survive a motion to dismiss, Judge Gary R. Brown of the US District Court for the Eastern District of New York said Thursday.

But the judge dismissed their claims of unjust enrichment, breach of fiduciary duty, and violations of the New York General Business Law.
