Duracell US Operations Inc. deceptively touts its Optimum line of batteries as longer-lasting and more powerful than all other AA batteries, a new would-be class suit in a New York federal court says.
The Optimum battery packages bear the statements “EXTRA LIFE*” and “EXTRA POWER,*” the Dec. 19 suit in the U.S. District Court for the Southern District of New York alleges.
Consumers reasonably draw the conclusion that the Optimum batteries provide additional power and a longer shelf-life and active-use life than other similar products, Robert Ferguson alleges.
But the opposite is true, the suit says.
