Duke Unable to Force Arbitration of Researcher’s Bias Claims

A Duke University School of Medicine researcher shouldn’t be forced to arbitrate her sexual assault and harassment claims against the school, a federal court was told.

Though a valid arbitration agreement existed between Duke and the researcher, enforcement is precluded by the 2021 Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, Magistrate Judge L. Patrick Auld told the US District Court for the Middle District of North Carolina Wednesday.
