DraftKings Must Face Suit After Canceling Bettor’s $150,000 Win

A DraftKings Inc. user can pursue his lawsuit against the sports betting company for allegedly canceling his bet the day after he won.

Matthew McAfee plausibly alleged DraftKings breached its contract when it failed to pay him the $150,000 he won from a seven-leg parlay, Judge James P. Hanlon of the US District Court for the Southern District of Indiana said in a Feb. 7 order. But since McAfee didn’t rely upon the allegedly deceptive act, he can’t bring claims under Indiana’s Deceptive Consumer Sales Act, the judge said.
