Dow Chemical Defeats Ex-Manager’s Age Bias, Retaliation Claims

Dow Chemical Co. is shielded from claims it discriminated and retaliated against a senior health service manager based on her age, according to a Fifth Circuit ruling Wednesday.

The worker failed to exhaust her administrative remedies before filing a suit in federal court, the US Court of Appeals for the Fifth Circuit held, affirming a district court’s decision that dismissed the case. Christy Bunker failed to request that the Equal Employment Opportunity Commission file her charges with the appropriate local agency as required by state law, the opinion said.
