White Rose Pizza LLC allegedly failed to properly reimburse delivery drivers for mileage and reasonable costs incurred for the business use of their vehicles, according to a new lawsuit.
Avery Florence, a former delivery driver, said that she was paid $3.25 per hour during her employment and was reimbursed only $0.40 per mile while driving an average of nine miles or more per delivery. The federal minimum wage has been $7.25 per hour since July 2009. The IRS business mileage reimbursement rate ranged between $0.545 and $0.58 per mile during the relevant time period, according to the complaint.
