Dollar Tree Employee Must Arbitrate Overtime Claims Individually

A Dollar Tree worker must take his Fair Labor Standards Act allegations to arbitration and won’t be able to represent any other current or former employees as a collective, a district court said.

Nelson Javier Lopez is subject to an arbitration agreement he signed with Dollar Tree Distribution Inc., Judge Anne C. Conway said in a Thursday order. The agreement also waived Lopez’s ability to bring either collective or class actions, requiring him to arbitrate on an individual basis.
