A new Virginia law banning federal law enforcement officers from concealing their identities and wearing face coverings during official operations is unconstitutional, the Justice Department says.
The law, which contains a separate provision limiting local authorities’ contracts to assist federal immigration enforcement agents, must be struck down, the DOJ said in a complaint filed Thursday in the US District Court for the Eastern District of Virginia. States have no authority to regulate federal government operations, it said.
