The Department of Justice has withdrawn a Biden-era suit challenging a Texas law that would allow state authorities to detain and remove people who come into the country illegally.
A notice filed by federal attorneys Tuesday in the US District Court for the Western District of Texas formally dismissed their lawsuit, which argued that only the federal government has jurisdiction to set immigration policy.
The matter had been set for trial July 8. A related lawsuit from immigrant advocacy groups and the county of El Paso, which was consolidated with the federal government’s case, is ongoing.
