DOE, Missouri Loan Entities Lack Immunity in Credit Report Suit

The Higher Education Loan Authority of the State of Missouri isn’t an arm of the state protected from liability by 11th Amendment immunity, the Tenth Circuit said Tuesday.

The US Department of Education also isn’t immune from suit under the Fair Credit Reporting Act, Chief Judge Jerome A. Holmes said for the US Court of Appeals for the Tenth Circuit.
