An artist who created an illustration of a dodo bird has alleged sufficient facts to go forward with his copyright infringement claim against Colossal Biosciences Inc., a company that aims to resurrect extinct species, a federal magistrate judge said.
Artist John Niehuss alleged the company used a “near identical copy” of his illustration in a fundraising and media push that allegedly raised millions of dollars, claiming copyright infringement in violation of the Copyright Act and false copyright management information in violation of the Digital Millennium Copyright Act.
