Dodge Ram Consumers Revive Fraud Claims Against FCA, Cummins

A group of consumers partially revived their long-running lawsuit against FCA US LLC and Cummins Inc., claiming the manufacturing companies misrepresented emissions of nitrogen oxides and the fuel economy in some Dodge Ram trucks.

Some of the consumers’ state law claims are based on theories that don’t rely on federal standards and turn on the companies’ advertisements to the public; the claims, therefore, aren’t preempted by the Clean Air Act, the US Court of Appeals for the Sixth Circuit said Aug. 8 in an unpublished opinion, affirming and reversing in part the lower court’s ruling.
