DOD Must Face Worker’s Retaliation Claims Over EEOC Complaints

The Department of Defense lost its bid to dismiss claims brought by an employee who alleges he faced retaliation after filing age and race discrimination complaints with the Equal Employment Opportunity Commission.

Gustavo Rivera adequately alleged that he faced adverse employment actions by his supervisors after he filed two EEOC complaints, Judge John A. Gibney of the US District Court for the Eastern District of Virginia wrote in a Tuesday opinion. But the court said Rivera failed to support his claims that he faced discrimination due to his race or age and dismissed those claims.
