A medical imaging equipment company failed to get a federal court to dismiss negligence and breach of contract claims from two patients who received healthcare from its clients.
The patients had standing to sue DMS Health Technologies in the US District Court for the District of North Dakota, a magistrate judge ruled Tuesday. Both of the plaintiffs say they’ve noticed more spam calls since the breach, but one said she was the victim of a cyberattack shortly after the DMS leak.
