Dismissal of Class Action Over American Airlines Fees Upheld

An American Airlines Inc. customer’s proposed class action was rightly dismissed since she failed to show the airline was unjustly enriched when she paid for travel assistance from a third party, a federal appeals court ruled Friday.

Kelsey Trotta couldn’t demonstrate any inequity stemming from the airline receiving fees from her purchase of travel assistance from Allianz Global Assistance, Judge Amul R. Thapar said in an unpublished opinion. The US Court of Appeals for the Sixth Circuit affirmed a lower court’s dismissal of Trotta’s proposed class action for failing to state a claim.
