Discover Beats Worker Disability Bias Suit Over Boss’ Touching

A Discover Financial Services employee with anxiety and panic disorder who sought permission to deviate from her telework arrangement only when she was having computer problems lacked a triable failure-to-accommodate claim, a federal court in Utah ruled.

The evidence showed Amy Fletcher, not Discover, caused the breakdown in the Americans with Disabilities Act’s job accommodation process, the US District Court for the District of Utah said. An employer isn’t liable for failing to accommodate an employee when the employee causes the interactive process to breakdown, it added.
