A disbarred attorney serving home confinement will have another chance to challenge the Georgia state bar’s policy preventing his readmission until his criminal sentence is complete, a federal appeals panel ruled Tuesday.
The US Court of Appeals for the Eleventh Circuit unanimously vacated a district court’s dismissal of Gregory Bartko’s challenge to the officials at the Georgia Office of Bar Admissions. The three-judge panel ruled that the lower court erred when it determined Bartko was bringing an identical, unsuccessful state court challenge to federal jurisdiction.
