Direct Building Supplies Must Face Suit Over Solar-Panel Calls

Solar-panel seller Direct Building Supplies LLC must face a proposed class action alleging it made telemarketing calls in violation of the Telephone Consumer Protection Act, a federal court ruled.

Plaintiff Gerard Jackson’s claims were covered by the TCPA despite the fact that the phone at issue in the lawsuit was a cell phone rather than a landline, and his allegations that he was a “residential telephone subscriber” were sufficient to survive the company’s motion to dismiss, Judge Matthew W. Brann of the US District Court for the Middle District of Pennsylvania said Wednesday.
