Diamondback Investment Worker Loses Appeal Over Drug Test Firing

Diamondback Investment Group LLC defeated the appeal of an employee claiming it wrongfully fired her for testing positive for THC, which she alleged was caused by her lawful health-related use of hemp-derived products when off duty.

The former contract liaison’s Americans with Disabilities Act claim failed because Diamondback’s explanation for firing her was a nondiscriminatory justification, the US Court of Appeals for the Fourth Circuit said Wednesday.
