DHS Youth Deportation Policy Shift Undone, Found Likely Unlawful

The Trump administration’s decision to cancel a Biden-era policy that gave youth immigrants deportation protections and legal work authorization was halted by a district court Wednesday.

The young people who were backlogged for US Citizenship and Immigration Services’ deferred-action program for Special Immigrant Juvenile Status are likely to succeed on the merits of their claims that the administration’s June rescission was unlawful, Judge Eric R. Komitee ruled. The US District Court for the Eastern District of New York partially granted their motion for a preliminary injunction, staying the rescission and subjecting it to further judicial review.
