Detained Noncitizens Should Get Bond Hearings, Judge Confirms

A California federal judge confirmed that a nationwide class of detained noncitizens are in fact entitled to bond hearings, and vacated a Trump administration policy that declared nearly all noncitizens subject to mandatory detention.

Judge Sunshine Sykes, of the US District Court for the Central District of California, certified the class and found them bond-eligible late last month. But according to the plaintiffs, immigration courts—which are part of the Executive Branch—were still declining to hear requests for bond. Government attorneys contended in response that Sykes’ initial order was not final or binding.
