Deputy Who Rejected Accommodation Loses Disability Bias Appeal

A former Okaloosa County, Fla., deputy’s failure to accept his employer’s reasonable accommodation offer doomed his Americans with Disabilities Act case, the Eleventh Circuit said Thursday.

Brandon Mundt’s rejection of the county’s offer that he work a non-sworn position as a dispatcher until he obtained medical clearance for his regular duties “places him outside the protections of the ADA,” the US Court of Appeals for the Eleventh Circuit said in a per curiam, unpublished opinion.
