A Massachusetts federal judge on Friday temporarily prohibited the Department of Homeland Security from deporting people to places other than an immigrant’s country of origin without giving them notice and a chance to object.
The temporary restraining order from Judge Brian Murphy of the US District Court of Massachusetts directs the department to provide notice of where the individual might be taken and give them a “meaningful opportunity” to seek relief in court.
The order was filed in a proposed class action objecting to the department’s lack of a written policy “to provide noncitizens either with notice or an opportunity to present a fear-based claim before DHS deports them to a third country where they face persecution, torture, and/or death.”
The case is D.V.D. v. DHS, D. Mass., No. 1:25-cv-10676, order filed 3/28/25.
